Terms of Service

Last Updated: May 20, 2026

These Terms and Conditions ("Terms") govern your access to and use of the website, content, forms, pages, resources, and related services provided by Alpha Track Digital Limited ("AlphaTrack Digital," "we," "us," or "our") through https://alphatrack.digital/.

By accessing or using our website, submitting an enquiry, requesting a consultation, or engaging with our services, you agree to these Terms. If you do not agree with these Terms, you should not use our website or services.

Specific client projects, deliverables, fees, timelines, revisions, cancellations, and service obligations may be governed by separate proposals, invoices, statements of work, contracts, or written agreements issued by AlphaTrack Digital.

1. About AlphaTrack Digital

AlphaTrack Digital is a digital marketing and growth agency providing services such as performance marketing, paid media, SEO, email marketing, marketing automation, analytics, conversion tracking, web development, strategy, media communication, and related digital services.

Our services may be delivered directly by our team or with the support of third-party tools, platforms, service providers, contractors, or partners.

2. Eligibility

You must be at least 18 years old to use our website, submit enquiries, request services, or enter into a business relationship with us.

By using our website or services, you confirm that you have the legal capacity and authority to agree to these Terms, either on your own behalf or on behalf of the company or organization you represent.

3. Use of Our Website

You may use our website for lawful purposes only.

You agree not to:

  • Use the website in any way that violates applicable laws or regulations.
  • Attempt to gain unauthorized access to our systems, website, servers, accounts, or data.
  • Interfere with the security, availability, or performance of the website.
  • Upload, transmit, or distribute viruses, malware, spam, or harmful code.
  • Use automated tools, scraping, bots, or similar technologies without our written permission.
  • Copy, misuse, or exploit our website content, brand assets, designs, or materials without authorization.
  • Misrepresent your identity, company, relationship with us, or purpose of enquiry.

We may restrict or block access where we reasonably believe there has been misuse, abuse, security risk, or violation of these Terms.

4. Enquiries, Proposals, and Client Engagements

Submitting an enquiry, booking a consultation, or contacting us does not automatically create a client relationship.

A client relationship begins only when we agree to provide services and the relevant proposal, invoice, statement of work, contract, or written agreement has been accepted by both parties.

Project scope, deliverables, fees, timelines, reporting arrangements, approvals, revision limits, access requirements, payment terms, refunds, cancellations, and service obligations will be set out in the relevant project document or agreement. Where there is a conflict between these Terms and a signed client agreement, the signed client agreement will take priority for that client engagement.

5. Payments, Fees, and Billing

Our website does not currently process payments directly.

Fees for AlphaTrack Digital services are normally agreed through proposals, invoices, statements of work, or client contracts. Third-party platform costs, advertising spend, software subscriptions, hosting, domains, creative production costs, and external vendor costs may be billed separately.

Work may be paused, delayed, or withheld where required payments, approvals, access, assets, or information are not provided on time.

6. Revisions, Refunds, and Cancellations

Refunds, revisions, cancellations, and project changes are governed by the relevant proposal, invoice, statement of work, or client agreement.

Unless otherwise agreed in writing, payments for completed work, strategy, consultation, setup, planning, research, campaign preparation, or delivered milestones may not be refundable. Revisions must remain within the agreed scope, and new requests or major changes may attract additional fees.

7. Third-Party Platforms and Services

Our work may involve third-party platforms and tools such as advertising platforms, analytics tools, CRM systems, automation platforms, website builders, hosting providers, email marketing tools, reporting tools, payment providers, and social media platforms.

These third-party services are controlled by their respective providers and may be subject to their own terms, policies, pricing, availability, limitations, and technical requirements.

We are not responsible for platform outages, policy changes, account restrictions, tracking limitations, or losses caused by third-party tools, vendors, platforms, or service providers outside our control. We take reasonable care in recommending, configuring, or using third-party tools, but we do not guarantee their continuous availability, accuracy, or performance.

8. Advertising, Marketing, and Performance Disclaimer

AlphaTrack Digital provides digital marketing, performance marketing, tracking, automation, strategy, creative, analytics, and related services.

While we aim to improve campaign performance, visibility, lead generation, conversion tracking, and marketing efficiency, we do not guarantee specific business results unless expressly stated in a signed agreement.

Marketing results may be affected by market conditions, offer quality, pricing, competition, budget, website experience, sales response time, brand reputation, platform algorithm changes, audience behaviour, creative quality, tracking limitations, and client approvals.

Any projections, forecasts, benchmarks, estimates, or recommendations we provide are for planning purposes and should not be treated as guaranteed outcomes.

9. Website Content and Intellectual Property

The information on our website is provided for general informational and marketing purposes. We make reasonable efforts to keep website content accurate and up to date, but we do not guarantee that all information is complete, current, error-free, or suitable for every business situation.

All content, designs, text, graphics, logos, icons, images, videos, layouts, documents, downloads, frameworks, processes, templates, and other materials on our website are owned by or licensed to AlphaTrack Digital, unless otherwise stated.

You may not copy, reproduce, modify, distribute, sell, publish, display, or exploit any part of our website or materials without our prior written permission. You may share links to public pages on our website for lawful and non-misleading purposes.

10. Client Materials and Access

Where you engage us for services, you may be required to provide materials, access, information, brand assets, platform permissions, website access, analytics access, ad account access, CRM access, content, approvals, or feedback.

You confirm that you have the rights, authority, and permissions necessary to provide any materials, data, or access given to us. You remain responsible for the accuracy, legality, and completeness of information, claims, offers, product details, pricing, testimonials, approvals, and materials you provide to us.

We are not responsible for delays, errors, or performance issues caused by incomplete, inaccurate, late, or unauthorized client-provided materials or access.

11. Confidentiality

Where confidential business, marketing, technical, financial, operational, or client information is shared between you and AlphaTrack Digital, both parties agree to handle such information with reasonable care.

Confidential information should not be disclosed to third parties except where necessary for service delivery, legal compliance, professional advice, or with the relevant party's permission. Specific confidentiality obligations may be further defined in a proposal, statement of work, non-disclosure agreement, or client contract.

12. Privacy and Cookies

Your use of our website and services may involve the collection and processing of personal information.

Our handling of personal information is explained in our Privacy Policy:

14. Disclaimer and Limitation of Liability

Our website and general online content are provided on an "as is" and "as available" basis.

To the maximum extent permitted by applicable law, we do not make warranties that the website will always be available, uninterrupted, secure, error-free, current, accurate, or free from harmful components.

To the maximum extent permitted by law, AlphaTrack Digital will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, revenue, data, goodwill, business opportunity, or business interruption. Nothing in these Terms limits liability for fraud, willful misconduct, or any liability that cannot legally be limited or excluded.

15. Indemnity

You agree to indemnify and hold AlphaTrack Digital, its directors, employees, contractors, representatives, and partners harmless from claims, losses, damages, liabilities, costs, and expenses arising from your misuse of our website or services, breach of these Terms, violation of applicable laws or third-party rights, or materials, data, claims, instructions, access, permissions, or content supplied by you.

16. Website Availability and Force Majeure

We may update, modify, suspend, or discontinue any part of our website, content, forms, resources, or online services at any time.

We do not guarantee that the website will always be available or uninterrupted. We will not be responsible for delay or failure caused by events beyond our reasonable control, including internet outages, platform downtime, cyber incidents, government actions, power failures, or failure of third-party service providers.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict of law principles.

Before starting formal legal proceedings, both parties agree to first attempt to resolve disputes through good faith discussions. If a dispute cannot be resolved informally, it will be submitted to the courts of competent jurisdiction in the Federal Republic of Nigeria.

18. General Terms

If any part of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

Our failure to enforce any provision does not mean we waive our right to enforce it later. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

These Terms, together with our Privacy Policy, Cookie Policy, and any applicable proposal, invoice, statement of work, contract, or written agreement, form the relevant agreement between you and AlphaTrack Digital.

19. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Last Updated" date and post the revised version on our website. Changes become effective when posted, unless otherwise stated.

Your continued use of our website after changes are posted means you accept the updated Terms.
